KNOXVILLE, TENNESSEE – James Randy Moss’ wife might have forgiven him, but the state of Tennessee hasn’t.

Prosecutors plan to move ahead with criminal charges against the former Tennessee Highway Patrol trooper, who resigned last week after being accused of receiving oral sex on duty from a Knoxville porn star during a traffic stop near Lebanon in Middle Tennessee.

“He’s going to lose his job, and he’s going to have felony charges,” said Tommy Thompson, 15th Judicial District attorney general. “We’re going to proceed on the thing.”

Moss, 40, had worked as a THP trooper for a decade when he stopped a pink Honda Accord driven by 21-year-old Barbie Cummings on state Route 840 as she drove home from visiting an aunt just after midnight May 7.

He wrote Cummings, whose real name is Justis Ellen Richert, a ticket for driving 92 mph in a 70 mph zone without registration or proof of insurance.

Cummings said he found painkillers in her car but threw them away after learning what she did for a living.

He visited her Web site from his in-car laptop, then let her give him oral sex and shot photos and video of the act, she said.

She posted the photos and video on her blog and later turned them over to THP investigators.

Tennessee Trooper Accused Of Tryst Fired
NASHVILLE, TENNESSEE ? A state trooper accused of letting a drug charge slide in exchange for oral sex from a porn star has been fired, the Tennessee Highway Patrol said Thursday.

The state also is considering criminal charges against James Randy Moss related to her claims that he threw away her bottle of prescription pills before their alleged encounter, Department of Safety spokesman Mike Browning said.

Moss has not indicated whether he would contest his firing and did not immediately return a message left at his home Thursday evening.

Moss was suspended earlier this week while the THP investigated the claims from the woman, who goes by stage name Barbie Cummings.

The department received an internal complaint about the allegations that were described on the porn star’s blog. The blog has been temporarily moved to another Web address and did not carry a full description of the tryst Thursday night.

Cummings, 21, has not returned calls for comment.

According to the citation issued by Moss, he stopped the woman’s pink Honda Accord for speeding outside Nashville on May 7. The citation identifies the woman by her legal name, Justis Richert.

The woman wrote on her blog that when the officer asked her if she had drugs in the car, she admitted to having some “happy pills.” Moss’ citation does not mention finding any illegal narcotics in the car.

The woman wrote that she told the officer that she made dirty movies, and they watched sex videos from her Web site using a laptop computer in his patrol car. He took the pills and scattered them in the brush beside the highway, she said.

“Then he asks me, what does it cost for someone like me to get anything like you,” she wrote.

She described performing oral sex on the officer outside his car in a secluded area. Photos that appear to be video stills she said he took during the incident and posted on her blog show her face but nothing that identifies the man as a trooper.

The trooper accepted, then shot photos and video footage of their encounter with his state-issued cameras, she said.

Cummings said Moss shared the photos and video clips with her, and she posted them on her Web site. The site was down Tuesday afternoon, with a note saying it was under construction.

Cummings believes the boasts by Moss to co-workers led to his suspension.

“This police officer went ahead and told (all) his coworkers, other police officers, and was bragging about it,” she wrote. “He isn’t in trouble because of the act itself, but that he chose to let it happen while he was on duty. There was no bribing, no (coercing) or convincing.”

Gov. Phil Bredesen said he’s waiting for the results of the internal investigation before drawing conclusions about a department he overhauled following allegations in 2004 of ticket-fixing and political cronyism.

KNOXVILLE, TENNESSEE - A Tennessee State Trooper is on paid leave after allegations surface about sex at a traffic stop.

The woman involved is apparently an adult video actress who lives in Knoxville. She has posted a vivid description of the incident on her personal website and blog.

This incident allegedly took place on May 7 in Middle Tennessee. It involves a trooper who works out of the Nashville district office. Another employee brought the incident to light.

THP spokesman Mike Browning confirms that the trooper [James Randy Moss], who WATE-TV is not naming, was placed on administrative leave May 11, after the allegations surfaced.

The incident allegedly took place in Wilson County near Highway 840 and Interstate 40.

Included below, in her blog, Barbie, an adult video actress, lists an entry about the trooper dated May 7. The site and blog is much to graphic to show here on our website or on TV.

In short, she writes she was pulled over early in the morning. The trooper asks what she does for a living and she tells him she makes “dirty movies.” The trooper then pulls up her website in his patrol car.

She writes that the trooper tossed “narcotic pills” she had into some bushes and she performed a sex act on him. Then she writes, “he asked me if he could take photos, I said yes, only if i can have them, he said okay. He even made little videos too.”

Those graphic pictures are on Barbie’s website and the Tennessee Highway Patrol along with TBI is investigating whether or not a video exists. The woman has been interviewed by the Criminal Investigations Division of THP. This trooper has worked with THP since the mid-1990’s. He will remain on leave while troopers investigate further.

I sometimes have these pills as I may take one or two before going to a club, and thats it. I have no addiction and use these more so, recreationally.

However, they are a “level 4�� is the term I think he used. Crack is a 2, Marijuana is a 6… He starts talking about the minimum punishment for this offense. It was an 11-29 with 30%, which means they sentence you to 11 months and 29 days in jail and you have to serve a minimum of 30%. Then he said I would be on six months of monitored probation, which means the likely hood of them allowing me to go to California, would probably be very minimal, if at all.

Thats when we start chatting about my trips to Los Angeles…

You all know where this is going?

I tell him I make dirty movies. He says he wished he had gotten into that industry.

I want to mind you all that I have been arrested many times before and was trying my hardest to be respectful, that always used to help.

He brings up my blog and we watch two of my video clips. I don’t even know what to do at this point, I thought I was going to jail.

So, he gets out of the car with the narcotics in hand and walks around to the side I am sitting in. He asks me if I would stand up and walk in front of the car, and told me I look even more beautiful in person. I smile.

He takes the hand full of pills and scatters them in the brush next to the interstate. Then he asks me, what does it cost for someone like me to get anything like you.

I said to him, “If you weren’t working…”

and he said, “don’t worry about me working!”

I said, “Okay, right now?”

He asks me to follow him to some desolate place he knew about, I did.

We moved to the back of the car, cause he didn’t want to take the chance of anyone pulling in. We were in the middle of nowhere, and it was 3 am-ish, there was no one to be found. Either way, he wanted to be safe.

Tennessee Highway Patrol Suspends State Trooper Randy Moss For On-Duty Sexual Act With Porn Star

KNOXVILLE, TENNESSEE ? A Tennessee Highway Patrol officer has been suspended after a woman claims she got out of a possible drug arrest because she had a sexual encounter with the officer.

There are allegations that the trooper, Randy Moss, while on duty, pulled over a Knoxville woman, who works in the porn industry.

He found out she had drugs in her car, disposed of the drugs, engaged in a sexual act with her, and then let her go.

The incident started as a routine traffic stop in Wilson County, at the intersection of Highway 840 and Interstate 40 in the early morning hours of May 7.

The woman, who calls herself Barbie Cummings, wrote in her online blog that she had been drinking and had liquor and drugs in her car.

On her blog, Cummings said the trooper warned her of the punishment for a drug offense, which leads them to a conversation about her frequent trips to Los Angeles.

“I tell him I make dirty movies,? she wrote.

He reportedly said, ?He wishes he had gotten into that industry.”

Cummings wrote that the trooper pulled up her Web site on his laptop computer and watched some of her movies online.

She also wrote that the two engaged in a sexual act and said he took pictures and a video of the incident.

Trooper Moss’ co-worker told the Tennessee Highway Patrol about the incident.

The department said, “The allegations include possible violations of departmental policies and possible criminal violations while on duty.”

Starting last Friday, the Tennessee Department of Safety placed Trooper Moss on administrative leave with pay pending an internal investigation.

The Department of Safety said they will not grant an on camera interview until the investigation is complete.
